1 Eligibility & store terms

1. Minimum age to use the Site. Our Site is intended for individuals who are at least 16 years old. It is not directed to children under 16, and we do not knowingly collect personal information from them.
2. Age to make a purchase. To place an order or enter into a binding transaction with us, you must be at least the age of majority in your state, province, or country of residence (18 in most U.S. states), or have the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. Lawful use. You may not use our products or the Site for any illegal or unauthorized purpose, nor may you violate any laws that apply to you (including, where applicable, the import/export and consumer laws of your country).
4. Account security. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You may not transfer, sell, or assign your account to anyone else. You must not transmit viruses or any destructive code.

2 General conditions & right to refuse service

1. Right to refuse service. We reserve the right to refuse service to anyone, for any lawful reason, at any time.
2. Personal use. Our products are sold for your own personal or household use and not for commercial resale, distribution, or export for resale, unless we have agreed otherwise in writing.
3. Order acceptance. When you place an order you are making an offer to purchase. Your order is not accepted until we confirm acceptance and have received and processed payment. We may accept, decline, limit, or cancel any order at our discretion, including after an order is placed, and will attempt to notify you using the contact details you provided.

3 Fraud, abuse & excessive returns

If we determine, in our reasonable discretion, that activity associated with an order or account indicates fraud, payment abuse, reselling, promotion or coupon abuse, or an unusually high rate of returns or claims, we reserve the right to take any of the following actions to the extent permitted by law: limit or cancel orders, refuse or limit returns and refunds, charge reasonable restocking or handling fees disclosed at the time, suspend or close accounts, and decline future service.

4 Accuracy of information

We do not warrant that information on the Site is always accurate, complete, or current. Content is provided for general information only and may change at any time without notice. Any reliance you place on Site information is at your own risk.

5 Modifications to service & prices

Prices, discounts, promotions, and product availability are subject to change without notice. The price charged will be the price in effect when your order is placed, as shown in your order confirmation. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges. We may modify, suspend, or discontinue any part of the Services at any time without liability to you or any third party.

6 Products, availability & display disclaimer

1. Availability. All products are subject to availability. We may limit quantities, discontinue products, or restrict orders to any person, region, or jurisdiction at our discretion.
2. Display disclaimer. We make reasonable efforts to display our products and their colors accurately, but we cannot guarantee that your device or monitor will display them accurately. Actual products may differ slightly in color or appearance from how they appear on your screen.
3. Collectibles & intended use. Our products are brick figures, figures, and related collectibles intended for display and collecting. Unless explicitly stated otherwise, items are not toys and may contain small parts. Adult supervision is recommended where appropriate, and we are not responsible for misuse, improper handling, or use inconsistent with a product's description.

7 International orders, customs & import duties

We currently ship from the United States and are expanding international availability. Where we accept international orders:

1. Duties, taxes & fees are your responsibility. You are responsible for all customs duties, import taxes, VAT/GST, brokerage, and any other fees imposed by the destination country. These charges are not included in the product price or shipping cost and are collected by the carrier or customs authority, not by us.
2. Delivery times vary. International delivery times are estimates only and may vary significantly due to customs processing, carrier handling, and other factors outside our control.
3. Compliance & refused parcels. You are responsible for ensuring the products can be lawfully imported into your country. If a parcel is refused, abandoned, or returned because duties were unpaid or import was not permitted, any refund will be net of shipping and non-recoverable fees.

8 Shipping, delivery & risk of loss

Shipping times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs processing, weather, or other events outside our control. Unless required otherwise by law, risk of loss and title pass to you once we transfer the products to the carrier. You are responsible for providing an accurate, complete shipping address; additional fees may apply for reshipment due to an incorrect address.

9 Returns, refunds & chargebacks

Returns and refunds are governed by our Refund & Return Policy, which sets out the return window, what is eligible, and how to start a return. All returns must be requested through the process described there. Submitting a return request does not guarantee approval — every request is reviewed, and we may decline returns that do not meet the criteria in that policy, even if a return form has been completed.

We encourage you to contact us first if there is any problem with your order so we can make it right. Initiating a chargeback or payment dispute without first contacting us may be treated as a breach of these Terms and may result in suspension of your account and escalation of the dispute. Reasonable restocking or handling fees may apply where disclosed and permitted by law.

10 Billing & account information

You agree to provide current, complete, and accurate purchase, billing, and account information, and to keep it up to date (including your email address and payment details) so we can complete your transactions and contact you as needed. You represent that you are authorized to use any payment method you provide and that the charges will be honored.

11 Payments & the Shopify platform

Our store is hosted by Shopify Inc. Payments are processed by Shopify and its authorized payment providers. Supported methods may include Shop Pay, Apple Pay, Google Pay, PayPal, and major credit and debit cards. We do not store full payment card numbers; payment data is handled by Shopify and its partners in accordance with applicable PCI-DSS standards.

12 Optional tools & third-party services

We may provide access to third-party tools or services over which we have no control and which we neither monitor nor have any input into. Such tools are provided "as is" and "as available" without warranties of any kind. Your use of optional third-party tools is entirely at your own risk, and you should review the relevant third party's own terms.

13 Third-party links

The Site may contain links to third-party websites or content that we do not own or control. We are not responsible for the content, accuracy, or practices of any third-party sites. Use of third-party websites is at your own risk, and you should review their policies before transacting with them.

14 User submissions & feedback

If you send us ideas, suggestions, reviews, photos, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that Feedback in any medium for any purpose, including commercial use. You represent that you own or have the rights to the Feedback, that it does not violate the rights of any third party, and that it is not unlawful, abusive, or obscene. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

15 Intellectual property

All Site content created by us — including text, graphics, logos, the "Fabled Figs" name and branding, images, product photography, and page designs — is owned by or licensed to Fabled Figs LLC and is protected by intellectual property laws. You may use the Services for your personal, non-commercial use only, and you may not reproduce, distribute, or create derivative works from our content without our prior written consent. All trademarks of third parties remain the property of their respective owners, and any references to them are for identification or description only and do not imply endorsement or affiliation. 16 Privacy

Your submission of personal information through the Services is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the Site in order to provide and improve the Services. By using the Services, you acknowledge that you have read our Privacy Policy.

17 Cookies & tracking

We use cookies and similar technologies, including essential cookies and, where permitted, analytics and advertising cookies. Depending on your location and settings, certain sharing of personal information may occur under applicable privacy laws. You can manage your preferences through our cookie settings. 18 Email & SMS communications

If and when we offer email or SMS marketing, enrollment will be opt-in and is never a condition of purchase. If you opt in, you consent to receive recurring automated messages from or on behalf of Fabled Figs; message and data rates may apply, and you may opt out at any time (for SMS, by replying STOP; for email, by using the unsubscribe link). Transactional messages relating to your orders (such as confirmations and shipping updates) are not marketing and may be sent regardless of marketing preferences.

19 Errors, inaccuracies & omissions

Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change, update, or cancel orders if any information is inaccurate, at any time and without prior notice (including after you have submitted your order).

20 Prohibited uses

You may not use the Site or our products to: (a) break any law or regulation; (b) infringe our intellectual property or that of others; (c) harass, abuse, or harm any person; (d) submit false or misleading information; (e) upload viruses or malicious code; (f) collect or track others' personal information; (g) spam, phish, pharm, pretext, spider, crawl, or scrape; or (h) interfere with or circumvent the security features of the Services. We may suspend or terminate your use of the Services for violating any of these prohibitions.

21 Relationship with Shopify

Fabled Figs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make are made directly with Fabled Figs LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Fabled Figs, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Fabled Figs.

22 Disclaimer of warranties

Except as expressly stated by us, the Services and all products are provided "as is" and "as available," without representations, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement, to the fullest extent permitted by law. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

23 Limitation of liability

To the fullest extent permitted by law, in no event shall Fabled Figs LLC or its owners, employees, affiliates, agents, contractors, suppliers, or licensors be liable for any indirect, incidental, punitive, special, or consequential damages of any kind — including lost profits, lost revenue, loss of data, or replacement costs — arising from your use of the Services or any products, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid for the product or order giving rise to the claim.

24 Indemnification

You agree to indemnify, defend, and hold harmless Fabled Figs LLC and its owners, employees, affiliates, agents, contractors, and licensors from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to (1) your breach of these Terms or any policy incorporated by reference, (2) your violation of any law or the rights of a third party, or (3) your use of the Services.

25 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the unenforceable portion will be severed without affecting the validity and enforceability of the remaining provisions.

26 Termination

These Terms are effective unless and until terminated by either you or us. We may terminate or suspend your access to the Services at any time, without notice, if we believe you have violated these Terms, and you will remain liable for all amounts due up to and including the date of termination. Obligations and liabilities incurred before termination, and the sections that by their nature should survive (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Severability), survive termination.

27 Entire agreement & waiver

These Terms and any policies posted by us on the Site constitute the entire agreement between you and us regarding the Services and supersede any prior agreements or communications. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any ambiguity will not be construed against the drafting party.

28 Governing law & venue

These Terms and any separate agreements by which we provide you Services are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles. You and Fabled Figs LLC agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida for any dispute arising out of or relating to these Terms or the Services, except where prohibited by applicable law.

You can review the most current version of these Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to the Site. It is your responsibility to check periodically for changes. Your continued use of or access to the Services after changes are posted constitutes acceptance of those changes.
